Afl\u0103 mai jos ce aspecte s-au eliminat \u0219i ce noi obliga\u021bii s-au introdus.<\/h1>\n<p>Telemunca presupune prestarea activit\u0103\u021bii profesionale a salariatului la domiciliu sau din alte puncte de lucru. Activit\u0103\u021bile la distan\u021b\u0103 se bazeaz\u0103 pe folosirea tehnologiei informa\u021biei \u0219i a comunica\u021biilor. \u0218i pentru c\u0103 \u00een contextul actual, telemunca este cea mai bun\u0103 modalitate pentru afaceri s\u0103 \u00ee\u0219i continue activitatea \u00een siguran\u021b\u0103, este preferat\u0103 de tot mai multe companii.<\/p>\n<p>Legea 81\/2018 a reglementat activitatea de telemunc\u0103, \u00eens\u0103 pentru a fi \u00een pas cu necesit\u0103\u021bile pie\u021bei de azi, s-a intervenit cu c\u00e2teva modific\u0103ri reg\u0103site \u00een OUG nr. 36\/2021, intrat\u0103 \u00een vigoare \u00een 6 mai.<\/p>\n<p>Iat\u0103 cele mai importante modific\u0103ri \u0219i aspecte legate de activitatea de telemunc\u0103, conform noii ordonan\u021be, modific\u0103ri care \u00eei vizeaz\u0103 pe angajatori \u0219i pe telesalaria\u021bi.<!--more--><\/p>\n<h2><span style=\"color: #0000ff;\"><strong>1. Cum este definit\u0103 telemunca<\/strong><\/span><\/h2>\n<p>Ordonan\u021ba de urgen\u021b\u0103 define\u0219te telemunca astfel: \u201eforma de organizare a muncii prin care salariatul, \u00een mod regulat \u0219i voluntar, \u00ee\u0219i \u00eendepline\u0219te atribu\u021biile specifice func\u021biei, ocupa\u021biei sau meseriei pe care o de\u021bine, \u00een alt loc dec\u00e2t locul de munc\u0103 organizat de angajator, folosind tehnologia informa\u021biei \u0219i comunica\u021biilor\u201d.<\/p>\n<h5><span style=\"color: #333399;\"><strong>Noutate:<\/strong><\/span> A disp\u0103rut condi\u021bia ca activitatea de telemunc\u0103 s\u0103 se fac\u0103 cel pu\u021bin o zi pe lun\u0103, \u00een alt loc dec\u00e2t locul de munc\u0103 organizat de angajator, condi\u021bie care era men\u021bionat\u0103 \u00eenainte \u00een Legea 81\/2018.<\/h5>\n<h5><span style=\"color: #333399;\"><strong>Men\u021biune:<\/strong><\/span> Conform Legii 81\/2018, \u00een cazul \u00een care salariatul refuz\u0103 prestarea acestui tip de activitate, \u201enu poate constitui motiv de modificare unilateral\u0103 a contractului individual de munc\u0103 \u015fi nu poate constitui motiv de sanc\u0163ionare disciplinar\u0103 a acestuia\u201d.<\/h5>\n<h2><span style=\"color: #0000ff;\"><strong>2. Unde se desf\u0103\u0219oar\u0103 activitatea de telemunc\u0103<\/strong><\/span><\/h2>\n<h5><strong><span style=\"color: #333399;\">Noutate:<\/span> <\/strong>Dac\u0103 \u00eenainte, locul sau locurile desf\u0103\u0219ur\u0103rii activit\u0103\u021bii de telemunc\u0103 trebuiau s\u0103 fie specificate \u00een contractul de telemunc\u0103, aceast\u0103 prevedere a fost scoas\u0103 din legisla\u021bie (din OUG). Atfel, se \u00eent\u0103re\u0219te ideea c\u0103 telemunca se poate desf\u0103\u0219ura de oriunde, f\u0103r\u0103 a mai fi necesar\u0103 aprobarea angajatorului, at\u00e2ta timp c\u00e2t telesalariatul p\u0103streaz\u0103 condi\u021biile de securitate \u0219i s\u0103n\u0103tate \u00een munc\u0103 la locul \u00een care \u00ee\u0219i desf\u0103\u0219oar\u0103 activitatea.<\/h5>\n<h2><span style=\"color: #0000ff;\"><strong>3. Cum se verific\u0103 activitatea telesalariatului<\/strong><\/span><\/h2>\n<p>Dreptul angajatorului de a verifica activitatea telesalariatului era specificat \u00een lege a se realiza \u00een condi\u021biile stabilite prin contractul de munc\u0103, f\u0103r\u0103 detalii concludente. \u00cen completare, noua Ordonan\u021b\u0103 aduce o completare important\u0103: \u201e\u00een principal prin utilizarea tehnologiei informa\u021biei \u0219i comunica\u021biilor, \u00een condi\u021biile stabilite prin contractul individual de munc\u0103, regulamentul intern \u0219i\/sau contractul colectiv de munc\u0103 aplicabil, \u00een condi\u021biile legii\u201d. De asemenea, programul de lucru este cel stabilit de comun acord \u00eentre cele dou\u0103 p\u0103r\u021bi.<\/p>\n<p>\u00cen ceea ce prive\u0219te munca suplimentar\u0103, aceasta poate fi efectuat\u0103 \u00een continuare \u201ela solicitarea angajatorului \u015fi cu acordul \u00een scris al telesalariatului cu norm\u0103 \u00eentreag\u0103\u201d (conform Legii 81\/2018).<\/p>\n<h5><span style=\"color: #333399;\"><strong>Important:<\/strong><\/span> Contractul individual de munc\u0103 cu clauz\u0103 de telemunc\u0103 trebuie s\u0103 se \u00eencheie \u0219i s\u0103 respecte condi\u021biile prev\u0103zute de Legea nr. 53\/2003 &#8211; Codul muncii, republicat\u0103, cu modific\u0103rile \u015fi complet\u0103rile ulterioare \u0219i de condi\u021biile prev\u0103zute \u00een cadrul Legii 81\/2018 (condi\u021bii specifice telemuncii).<\/h5>\n<h2><span style=\"color: #0000ff;\"><strong>4. Obliga\u021biile angajatorului privind securitatea \u0219i s\u0103n\u0103tatea \u00een munc\u0103 (SSM sau Protec\u021bia Muncii) a telesalariatului<\/strong><\/span><\/h2>\n<p>Conform Legii\u00a0 81\/2018, angajatorul trebuie s\u0103 asigure anumite condi\u021bii pentru ca telesalariatul s\u0103 \u00ee\u0219i poat\u0103 desf\u0103\u0219ura activitatea la distan\u021b\u0103, \u00een condi\u021bii de siguran\u021b\u0103, astfel:<\/p>\n<p>a) <strong>s\u0103 asigure mijloacele aferente tehnologiei<\/strong> informa\u0163iei \u015fi comunica\u0163iilor \u015fi\/sau <strong>echipamentele de munc\u0103 sigure<\/strong> necesare prest\u0103rii muncii, cu excep\u0163ia cazului \u00een care p\u0103r\u0163ile convin altfel;<\/p>\n<p>b) <strong>s\u0103 instaleze, s\u0103 verifice \u015fi s\u0103 \u00eentre\u0163in\u0103 echipamentul<\/strong> de munc\u0103 necesar, cu excep\u0163ia cazului \u00een care p\u0103r\u0163ile convin altfel;<\/p>\n<p>c) s\u0103 asigure condi\u0163ii pentru ca <strong>telesalariatul s\u0103 primeasc\u0103 o instruire suficient\u0103 \u015fi adecvat\u0103 \u00een domeniul securit\u0103\u0163ii \u015fi s\u0103n\u0103t\u0103\u0163ii \u00een munc\u0103<\/strong>, \u00een special sub form\u0103 de informa\u0163ii \u015fi instruc\u0163iuni de lucru, specifice locului de desf\u0103\u015furare a activit\u0103\u0163ii de telemunc\u0103 \u015fi utiliz\u0103rii echipamentelor cu ecran de vizualizare: la angajare, la schimbarea locului de desf\u0103\u015furare a activit\u0103\u0163ii de telemunc\u0103, la introducerea unui nou echipament de munc\u0103, la introducerea oric\u0103rei noi proceduri de lucru.<\/p>\n<h2><span style=\"color: #0000ff;\"><strong>5. Obliga\u021biile telesalariatului privind securitatea \u0219i s\u0103n\u0103tatea \u00een munc\u0103 \u00een activitatea desf\u0103\u0219urat\u0103<\/strong><\/span><\/h2>\n<p>a)\u00a0s\u0103 informeze angajatorul cu privire la echipamentele de munc\u0103 utilizate \u015fi la condi\u0163iile existente la locurile desf\u0103\u0219ur\u0103rii activit\u0103\u0163ii de telemunc\u0103 \u015fi s\u0103 \u00eei permit\u0103 acestuia accesul, \u00een m\u0103sura \u00een care este posibil, \u00een vederea stabilirii \u015fi realiz\u0103rii m\u0103surilor de securitate \u015fi s\u0103n\u0103tate \u00een munc\u0103, necesare conform clauzelor din contractul individual de munc\u0103, ori \u00een vederea cercet\u0103rii evenimentelor;<\/p>\n<p>b) s\u0103 nu schimbe condi\u0163iile de securitate \u015fi s\u0103n\u0103tate \u00een munc\u0103 de la locurile \u00een care desf\u0103\u015foar\u0103 activitatea de telemunc\u0103;<\/p>\n<p>c) s\u0103 utilizeze numai echipamente de munc\u0103 care nu prezint\u0103 pericol pentru securitatea \u015fi s\u0103n\u0103tatea sa;<\/p>\n<p>d) s\u0103 \u00ee\u015fi desf\u0103\u015foare activitatea cu respectarea dispozi\u0163iilor privind obliga\u0163iile lucr\u0103torilor, a\u015fa cum sunt ele prev\u0103zute \u00een Legea securit\u0103\u0163ii \u015fi s\u0103n\u0103t\u0103\u0163ii \u00een munc\u0103 nr. 319\/2006, cu modific\u0103rile ulterioare, precum \u015fi \u00een conformitate cu clauzele contractului individual de munc\u0103;<\/p>\n<p>e) s\u0103 respecte regulile specifice \u015fi restric\u0163iile stabilite de c\u0103tre angajator cu privire la re\u0163ele de internet folosite sau cu privire la folosirea echipamentului pus la dispozi\u0163ie.<\/p>\n<h5><span style=\"color: #333399;\"><strong>Noutate:<\/strong> <\/span>\u00cen OUG nr. 36\/2021, s-a introdus o nou\u0103 obliga\u021bie esen\u021bial\u0103, care nu era men\u021bionat\u0103 \u00een lege, care \u021bine de confiden\u021bialitatea datelor companiei, astfel: \u201eSalaria\u021bii cu munca la domiciliu au obliga\u021bia de a respecta \u0219i de a asigura confiden\u021bialitatea informa\u021biilor \u0219i documentelor utilizate \u00een timpul muncii la domiciliu\u201d.<\/h5>\n<h2><span style=\"color: #0000ff;\"><strong>6. Consecin\u021bele nerespect\u0103rii prevederilor legale<\/strong><\/span><\/h2>\n<p>Nerespectarea prevederilor legale referitoare la telemunc\u0103, conform Legii nr. 81\/2018, poate aduce o serie de contraven\u021bii, care se sanc\u021bioneaz\u0103 cu amenzi de p\u00e2n\u0103 la 10.000 de lei pentru angajator, \u00een cazul \u00een care acesta nu prevede \u00een mod expres \u00een contractul individual de munc\u0103 sau \u00een actul adi\u021bional al telesalariatului, prestarea activit\u0103\u021bii \u00een regim de telemunc\u0103.<\/p>\n<p>Telemunca este extrem de important\u0103, deoarece utilizarea tehnologiilor moderne vine \u00een sprijinul angajatorilor \u0219i angaja\u021bilor, flexibiliz\u00e2nd \u0219i simplific\u00e2nd rela\u021biile de munc\u0103, \u00een raport cu evolu\u021bia dinamic\u0103 a pie\u021bei muncii.
